Hostelworld.com – “What kind of traveller are you?” – Privacy Notice (the “Notice”)

Hostelworld.com Limited (the “Company”, “we”, “us” or “our”) collects and processes personal information relating to you in connection with the competition entitled “What kind of traveller are you?” (the “Competition”). We do this in compliance with our obligations under applicable data protection law.  This notice explains what personal data relating to you is collected, the purposes for which it is used, the third parties to whom it may be disclosed and how you can exercise your rights in relation to your personal data.

This notice should be read in conjunction with the Competition’s terms and conditions (available here), as some of the terms in this Notice are defined in those terms and conditions.

Personal Data Collected

The types of personal data relating to you that we collect and process may include:

  • your name, surname, email address, age and country of residence;
  • your responses to survey questions which will be collected on an anonymous basis; and
  • if you are declared to be the Winner of the Competition in accordance with the Competition’s terms and conditions, you will be required to provide content such as pictures, and social media stories or videos.

Please note that if you do not provide the above information you will not be entered into the competition.

Purposes of Processing and Legal Bases

  • Your email address will be used for the purposes of carrying out the Draw. The legal basis for this processing is that it is necessary for the performance of our contract with you.
  • Your email address will be used for direct marketing purposes. The legal basis for this processing is the consent you provide when you enter the Competition.
  • If you are declared to be the Winner of the Competition your name, country of residence and other content such as pictures, social media stories, and videos, may be uploaded to our website and social media sites including our blog, or may be used for our e-newsletter. The legal bases for this processing are that it is in our legitimate interests to carry on marketing activities, and that it is necessary for the performance of our contract with you.

Recipients of Data

We may disclose your personal data to third party recipients in connection with the above purposes, including:

  • to social media service providers and other IT service providers including but not limited to SurveyMonkey and Instagram;
  • to competent regulatory authorities and bodies as requested or required by law;
  • to other members of our corporate group; and

Retention

We will only retain your personal data for as long as is necessary to fulfil the purpose for which it was collected or to comply with legal, regulatory or internal policy requirements and, if relevant, to deal with any claim or dispute that might arise in connection with your contract.

Transfers Abroad

In connection with the above we may transfer your personal data outside the European Economic Area, including to a jurisdiction which is not recognised by the European Commission as providing for an equivalent level of protection for personal data as is provided for in the European Union. If and to the extent that we do so, we will ensure that appropriate measures are in place to comply with our obligations under applicable law governing such transfers, which may include entering into a contract governing the transfer which contains the ‘standard contractual clauses’ approved for this purpose by the European Commission or, in respect of transfers to the United States of America, ensuring that the transfer is covered by the EU-US Privacy Shield framework. Your Rights

You have the following rights, in certain circumstances and subject to certain restrictions, in relation to your personal data:

  • the right to access your personal data;
  • the right to request the rectification and/or erasure of your personal data;
  • the right to restrict the use of your personal data;
  • the right to object to the processing of your personal data;
  • the right to receive your personal data, which you provided to us, in a structured, commonly used and machine-readable format or to require us to transmit that data to another controller; and
  • where our processing of your personal data is based on you having provided consent, the right to withdraw your consent to the processing at any time.

Complaints

Hostelworld.com Terms and Conditions

  1. Competition description:

Competition Name (the “Draw”): “What kind of traveller are you?”

Description of the Prize (the “Prize”):  the Prize includes up to €1,000 to spend on a hostel or hostels listed on www.hostelworld.com for a stay or stays for two people (the Winner and their Nominated Friend (as defined below)) for a maximum period of 10 nights.  The Prize also includes free return economy flights for the Winner and their Nominated Friend from the nearest available international (or if applicable, domestic) airport, up to a maximum price of €2,000 and €2,000 in spending money

The accommodation will be subject to availability.

This €2,000 cash sum that will be wire transferred into the Winner’s bank account for the trip.

Travel must take place strictly between 30th June 2018 and 31st December 2018.

The Winner is responsible for all taxes, costs and other expenses that are not explicitly included in the prize, and agrees that upon accepting the prize he/she does so entirely at his/her own risk and responsibility.

There is no cash equivalent of the Prize.

The Prize will be delivered to the e-mail address which is given by the Winner after being chosen and contacted.

Number of Winners (the “Winner”): There will be one (1) global Winner of the Prize across all channels. The Winner will be able to bring one (1) friend to join them on this trip (the “Nominated Friend”).

Third Party Provider of the Prize (the “Partner”):

Draw Open: The Draw will be open for participation from 00:01am GMT on 1st May 2018 until 23:59 pm GMT on 31st May 2018.[1]

Date Draw Will Take Place: The Draw for the Prize will be held on 14:00 pm GMT on 8th June 2018.[2] It will be a random draw.

Winner/Alternative Winner will be notified by: The Winner/Alternative Winner will be notified by the Promoter via email.

Date by which Winner must claim their Prize:      Within three (3) calendar days from the date of notification that they are a Winner in accordance with Clause 8.

Date by which Alternative Winner must claim their Prize: Within three (3) calendar days from the date of notification that they are an Alternative Winner in accordance with Clause 8. If the first alternative winner is unable to confirm their prize within three (3) calendar days, the second Alternative Winner will be notified and this will repeat on a rolling basis.

  1. The promoter of the Draw is Hostelworld.com Limited (hereafter known as the “Promoter”) of Floor 2, One Central Park, Leopardstown, Dublin 18, Ireland.
  2. By entering the Draw, the “Entrant” agrees to be bound by these terms and conditions and agrees that the decision of the Promoter is binding and final.
  3. No purchase is necessary for entry into the Draw.
  4. The Prize is provided by the Promoter and, where relevant, the Partner.
  5. The Promoter does not own or run any of the services which are provided as part of the Prize. In order to avail of the Prize, the Winner and the Nominated Friend will be required to agree to any relevant terms and conditions or contract required by the third parties supplying the Prize including, where relevant, the Partner. The Winner acknowledge that the Promoter will not be party to any such agreements with the third party suppliers, and will not be liable to the Winner in respect of the terms of those agreements whether directly or indirectly.
  6. The Prize is subject to availability, and is at the discretion of Promoter and, where relevant, the Partner.
  7. The Prize is non-transferable, cannot be used in conjunction with any other offer and can only be claimed by the Winner who are notified by the Promoter in accordance with the procedure detailed in Clause 1 above. To claim the Prize, the Winner and the Nominated Friend may have to accept certain terms and conditions, which will be sent to the Winner when they are notified that they have won the Prize in accordance with Clause 1.
  8. Where the Prize includes flights, the departure airport used will be dependent on the direct availability from the Winner’s nearest available domestic or international airport, which may not necessarily be the closest. The prize is for one outbound and one inbound flight and does not include multiple flights from different airports.
  9. The Winner and the Nominated Friend may need a visa to travel to the country in which the Prize is located, which they should arrange with the relevant country’s local Embassy, at their own expense. It is the responsibility of the Winner and the Nominated Friend to comply with any of relevant country’s visa requirements. Approval is at the discretion of the relevant country’s Embassy and the Promoter and Partner cannot be held responsible for any visa applications being rejected.
  10. Travel insurance is not included in the Prize and it is the responsibility of the Winner and the Nominated Friend to arrange suitable cover for their needs if this is relevant to the Prize.
  11. Entrants and the Nominated Friend must be aged 18 (eighteen) or over. To enter the Draw, Entrants must answer two survey questions. In entering the Draw, the Entrant does so at his/her own risk and on his/her own initiative, and is responsible for complying with local laws, to the extent any local laws apply. Entry into the Draw may be unlawful under the laws of the applicable jurisdiction and if entry in the Draw is unlawful, the Entrant will breach these terms and conditions and will be immediately disqualified from the Draw. Entrants through Facebook are required to fully and correctly complete the entry form, which is available on surveymonkey.com. To enter the Draw, Entrants must provide their name, surname, email address, age, country of residence, and answer four survey questions.
  12. The Draw is not open to employees or agents of the Promoter or any affiliated companies or subsidiaries or any third parties involved in the Draw including, where relevant, the Partner.
  13. The Draw is open for participation between the dates set out in Clause 1 above. The Entrants will be required to comply with any Entry Requirements. The Draw for the Prize will be held on the date set out in Clause 1 above.
  14. The Winner of the Draw shall be chosen at random by the Promoter from all entries that meet the Entry Requirements.
  15. By entering the Draw each Entrant agrees to allow the Promoter to use their name and country of residence, which will be displayed as a Winner on the Hostelworld.com blog as well as on the Instagram post.
  16. By entering the Draw each Entrant agrees, in the event they are a Winner, to participate in such promotional activity as is reasonably requested by the Promoter, such as providing the Promoter with content (e.g. pictures, Instagram stories or videos) for the Hostelworld.com website, blog, e-newsletters, and social media channels for further marketing purposes following the Draw.
  17. At the time of entry into the Draw the Entrant will agree to subscribe to Hostelworld.com e-newsletters.
  18. The Winner shall claim the Prize by the date set out in Clause 1. In the event that a Winner fails to respond in writing via e-mail by that date, chooses not to accept the Prize, is ineligible for the Draw or fails to duly complete, execute and return any document required by the Promoter, he/she shall be immediately disqualified from the Draw and he/she shall forthwith relinquish any right or entitlement to the Prize. The Promoter shall then draw from all remaining eligible entries and an alternative Entrant shall be selected as winner of the relevant Prize (the “Alternative Winner“).
  19. The Alternative Winner shall be notified in accordance with the procedure detailed in Clause 1 above. The Alternative Winner shall claim the Prize by the date set out in Clause 1. In the event that the Alternative Winner fails to respond in writing via e-mail by that date, chooses not to accept the Prize, is ineligible for the Draw or fails to duly complete, execute and return any document required by the Promoter, he/she shall be immediately disqualified from the Draw and he/she shall forthwith relinquish any right or entitlement to the Prize. The Prize shall then be re-issued to the next Alternative Winner on a rolling basis.
  20. Only one entry per email address or, where relevant, social media account (last entry) will be accepted. The Promoter will not accept multiple entries using the same email address or social media account.
  21. In the event of a dispute regarding the identity of the individual that submitted an online entry, the entry will be deemed submitted by the authorised account holder of the e-mail or social media account.
  22. Each Entrant releases and holds the Promoter and its employees, agents, sub-contractors and consultants harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Draw or resulting from acceptance, possession, or use of any Prize, including without limitation, personal injury, property damage and claims based on publicity rights, defamation, or invasion of privacy.
  23. The receipt by an Entrant of any Prize is conditional upon that Entrant and the Nominated Friend executing all relevant releases and other documentation and providing such assistance as the Promoter may reasonably require.
  24. The Promoter shall not be liable for any breach of its obligations hereunder resulting from causes beyond its reasonable control including but not limited to fires, strikes (of its own or other employees), insurrection or riots, embargoes, delays in transportation, requirements or regulations of any civil or military authority, computer viruses, bugs, tampering, unauthorised intervention, fraud or technical failure and the Promoter shall be entitled to cancel, terminate, modify or suspend the Draw and these terms and conditions without liability.
  25. The Promoter reserves the right in its sole discretion to modify or discontinue this Draw or to restrict its availability to any person, at any time, for any or no reason, and without prior notice or liability to Entrants.
  26. These terms and conditions will be governed by and construed in accordance with the laws of Ireland and the Entrant hereby agrees that for the benefit of the Promoter and without prejudice to the right of the Promoter to take proceedings before any other court of competent jurisdiction, that the courts of Ireland shall have jurisdiction to hear and determine any suit, action or proceedings that might arise out of or in connection with these terms and conditions and for such purposes the Entrant irrevocably submits to the jurisdiction of such courts.
